Buying Farmland to Build On? Check Land Conversion Status First

Agricultural land in Uttar Pradesh is legally restricted to agricultural use by default. If there's any chance you'll want to build on it — a farmhouse, a resort, anything non-agricultural — that restriction needs to be formally lifted before construction is legal.

Why Agricultural Land Has Use Restrictions by Default

Land revenue records in UP classify land by its intended use, and agricultural land carries protections and restrictions tied to that classification. Building on agricultural land without changing that classification first isn't a paperwork technicality — it can result in construction being stopped, or worse, demolished.

What Section 80 Land Conversion (Still Called "Section 143") Actually Involves

The process of converting agricultural land to non-agricultural status in UP is governed today by Section 80 of the UP Revenue Code, 2006. It replaced the older Section 143 of the UP Zamindari Abolition and Land Reforms Act, 1950 — a name that's stuck around in everyday conversation even though the legal provision has changed. The Sub-Divisional Magistrate (SDM) is the authority who issues this conversion order.

Who's Responsible — Buyer or Seller?

This is a point of frequent confusion and disagreement. There's no universal rule — it depends entirely on what's negotiated and documented before the sale. Get explicit written agreement on who handles the conversion, who pays the associated fees, and what happens if it's delayed or denied.

Questions to Ask Before You Sign

Has this specific parcel already completed Section 80 conversion? If not, is that a condition of the sale, and who bears the cost and timeline risk? Always verify the current land classification directly through revenue records rather than relying on a verbal assurance.
